1. Acceptance of Terms
By accessing or using WebPinch, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. These terms apply to all users, including visitors, registered users, and contributors.
2. Description of Service
WebPinch is a visual website feedback and bug tracking tool. It provides a Chrome extension for pinning feedback directly on web pages, automatic screenshot and metadata capture, and a Kanban board for organizing and tracking feedback. The service is provided "as is" and we reserve the right to modify or discontinue features at any time.
3. User Accounts
To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
4. Plans & Billing
WebPinch offers free and paid subscription plans. Paid plans are billed monthly or annually as selected at the time of purchase. Prices are subject to change with 30 days notice. Refunds are handled on a case-by-case basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
5. User Content
You retain ownership of all content you create through WebPinch, including feedback pins, comments, and screenshots. By using the service, you grant WebPinch a limited license to store, display, and process your content as necessary to provide the service. You are solely responsible for the content you create and share.
6. Acceptable Use
You agree not to use WebPinch to: violate any laws or regulations; infringe on intellectual property rights; transmit malicious software; attempt to gain unauthorized access to our systems; use the service for competitive analysis; or engage in any activity that disrupts or interferes with the service.
7. Intellectual Property
WebPinch and its original content, features, and functionality are owned by WebPinch and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.
8. Third-Party Services
WebPinch may integrate with or contain links to third-party services. We are not responsible for the content, privacy policies, or practices of these third-party services. Your use of third-party services is governed by their respective terms and conditions.
9. Limitation of Liability
To the maximum extent permitted by law, WebPinch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of the service.
10. Termination
We may terminate or suspend your account and access to the service at our sole discretion, without prior notice, for conduct that we believe violates these terms or is harmful to other users, us, or third parties. Upon termination, your right to use the service ceases immediately.
11. Modifications to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the service. Continued use of WebPinch after changes are posted constitutes acceptance of the modified terms.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts located in India.
